Circular of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency No. 5/SE-400.HK.02/II/2022 on National Health Security (JKN) Participation During the Registration Application of Transfer of Land Rights or Apartment Units Ownership Due to the Sales and Purchase

  • Sets out guidelines that should be used by regional land offices in order to ensure that all applicants looking to register land rights or transfers of apartment unit ownership due to the completion of sales and purchases (“Applicants”) are active participants in the National Health Security (Jaminan Kesehatan Nasional – “JKN”) program.
  • Participation in the JKN program is a requirement for applications for the registration of land rights and for transfers of apartment unit ownership due to the completion of sales and purchases (“Application”) and is now mandatory for rights recipients or sellers, which include the following parties: 1) Indonesian citizens; 2) Foreign citizens that have been working in Indonesia for at least six months; and 3) Legal entities, as represented in accordance with the relevant JKN program participation provisions.
  • Participation in the JKN program will be verified on a gradual basis through host-to-host electronic systems operated by the Minister and the Social Security Agency for Health (Badan Penyelenggara Jaminan Sosial Kesehatan – “BPJS Kesehatan”). During the transition period that will run until this system is ready, the following measures should be undertaken: 1) Applicants should enclose screenshots proving their participation in the JKN program, as accessed through the JKN Mobile app, the JKN Chat Assistant or other means provided by BPJS Kesehatan; and 2) The heads of regional land offices should coordinate with local BPJS Kesehatan offices and should assist with verifications of JKN program participation.
  • In the event that the results of a given JKN program participation verification reveal that an Applicant has yet to become a JKN program participant or is classified as an inactive participant, then the following consequences will apply: 1) Applications may still be accepted and processed in accordance with relevant laws and regulations; and 2) When receiving registration service results, Applicants must show proof of active JKN program participation or must have become active participants in the JKN program.
