- Back in 2020, Circular of the Minister of Manpower No. M/3/HK.04/III/2020 on the Protection of Workers/Laborers and Business Continuity in Order to Prevent and Mitigate the Spread of COVID-19 was issued so that governors across Indonesia would be able to protect all workers against a backdrop of the escalating Corona Virus Disease 2019 (“COVID-19”) pandemic through the following measures: 1) Making efforts to prevent the spread of and to handle COVID-19 within the workplace (e.g. through the recording and reporting of all COVID-19 cases); and 2) Implementation of wage protections for workers in relation to the COVID-19 pandemic (e.g. workers categorized as persons under surveillance [ODP] and workers confirmed with COVID-19 were permitted to take leave whilst still receiving wages, while companies were encouraged to adjust payments to workers in accordance with prior agreements).
- Through the issuance of this new Circular, such measures are now no longer applicable, in line with the following conditions: 1) The scale of COVID-19 mitigation measures that have been introduced through vaccination programs and the implementation of strict health protocols; 2) Economic recovery programs that have been implemented through the granting of business facilities, subsidized wage aid for employees/laborers and the implementation of community restrictions that have impacted upon business activities; and 3) The establishment of harmonized industrial relations through the granting of protections and welfare to employees/workers, as well through the increasing of company productivity rates.
